May 1, 2026 Update
The Court granted preliminary approval of the Settlement on April 2, 2026. Notice to Settlement Class Members was mailed out today.

A generic copy of the Class Notice sent to each settlement Class Member is also available in the COURT DOCUMENTS section at the bottom of this page. If you want another copy of the notice sent to you, please contact Phoenix Settlement Administrators directly, at (800) 523-5773.
Settlement Class Members need do nothing to receive payment. However, there are deadlines if you want to object or opt out of the settlement. Please review the IMPORTANT DATES section at the bottom of this page for these deadlines. Details are also available in the Class Notice document.
February 17, 2026 Update
The Parties filed a Stipulation regarding curative class notices. The Court signed an Order February 17, 2026 ordering corrective notice to 139 individuals who were sent Notice in 2024 in error. The Order, which includes the Notices to be sent, is available in the COURT DOCUMENTS section at the bottom of this page.
November 5, 2025 Update
The Parties filed a Notice of Conditional Settlement on 11/5/2025. As a result, the trial did not occur and the Parties are instead seeking approval of the class settlement with the Court.
Once settlement is approved, we will update on this website.
April 19, 2023 Update
On April 19, 2023, Plaintiff presented a motion for the Court for Class Certification. On July 11, 2024, the Court partially granted the motion, certifying the following Class and Subclasses of people:
The 9/80 Class, defined as:
All non-union current and former hourly-paid or non-exempt employees who worked a 9/80 alternative workweek schedule for any of the Defendants within the State of California at any time during the period from April 3, 2015 to the present.
The Following 9/80 Subclasses:
Alternative Workweek Daily Overtime Subclass: All non-union current and former hourly-paid or non-exempt employees who worked for any of the Defendants within the State of California and pursuant to a 9/80 alternative workweek schedule and were not paid daily overtime for work in excess of eight (8) but less than ten (10) hours at any time during the period from April 3, 2015 to the present.
Alternative Workweek Conversion Subclass: All non-union current and former hourly-paid or non-exempt employees who worked for any of the Defendants within the State of California and were converted from a 5/40 schedule to a 9/80 alternative workweek schedule at any time during the period from April 3, 2015 to the present.
Alternative Workweek Weekly Overtime Subclass: All non-union current and former hourly-paid or non-exempt employees who worked a 9/80 alternative workweek schedule and who worked in excess of forty (40) hours in a calendar week for any of the Defendants within the State of California at any time during the period from April 3, 2015 to the present.
9/80 Terminated Employee Subclass: All non-union current and former hourly-paid or non-exempt employees who worked a 9/80 alternative workweek schedule for any of the Defendants within the State of California at any time during the period from April 3, 2016 to the present, and who were not properly paid all wages on termination or within 72 hours thereof.
9/80 Wage Statement Subclass: All non-union current and former hourly-paid or nonexempt employees who worked a 9/80 alternative workweek schedule for any of the Defendants within the State of California and who received an itemized wage statement at any time during the period from April 3, 2016 to the present.
Boeing’s Deadline to Produce Data of the Certified Class and Subclasses to the Mailing Administrator is September 12, 2024.
The Deadline to be Excluded from the Case is December 30, 2024.
